These Terms of Service ("Terms") govern your access to and use of the 3eyadah clinic management platform (the "Service"), provided by DevLoops LLC ("we", "us", or the "Company"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Definitions
The "Service" means the 3eyadah platform and all of its features, including appointments, patient records, online sessions, real-time chat and billing. "User" or "you" means the clinic, doctor, staff member or person accessing the Service. "Patient Data" means any personal or health information you enter into or store within the Service.
2. Eligibility & Accounts
You must be legally authorised to represent your clinic or healthcare practice to create an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
You must notify us immediately of any unauthorised use of your account. We are not liable for any loss arising from your failure to protect your credentials.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms and the applicable laws of the Hashemite Kingdom of Jordan. You may not use the Service to store unlawful content, attempt to breach our systems, transmit malware, or access data you are not authorised to access.
You are solely responsible for the accuracy of the Patient Data you enter and for obtaining the necessary consents from your patients to process their data through the Service.
4. Patient Data & Privacy
You remain the controller of the Patient Data you enter, and we process it on your behalf as your service provider. Our Privacy Policy explains how we collect, use and protect data.
You are responsible for meeting all of your own legal obligations to your patients regarding the privacy and confidentiality of their data.
5. Subscriptions & Payment
Some features of the Service may require a paid subscription. Fees are charged according to the plan you agree to and are non-refundable except where required by law. We reserve the right to change our pricing with reasonable prior notice.
Electronic invoices are issued in line with Jordan's national e-invoicing requirements where applicable.
6. Availability & Support
We strive to provide a reliable Service with high uptime, but we do not guarantee that the Service will be uninterrupted or error-free. We may carry out scheduled maintenance or updates that temporarily affect availability.
7. Intellectual Property
All rights in the platform, its software, designs and trademarks — including the "3eyadah" name and logo — remain the exclusive property of DevLoops LLC. No ownership rights are granted to you under these Terms, other than the right to use the Service as described.
8. Termination
You may terminate your account at any time. We may suspend or terminate the Service if you breach these Terms or if required by law. On termination, you may request an export of your data within a reasonable period before it is deleted in accordance with our policies.
9. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. The Service is not a substitute for professional clinical judgment; responsibility for all medical decisions rests entirely with the care providers.
To the maximum extent permitted by law, DevLoops LLC is not liable for any indirect, consequential or incidental damages, and our total liability shall not exceed the amounts you paid for the Service in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify, defend and hold harmless DevLoops LLC from any claims or losses arising out of your use of the Service, your breach of these Terms, or your violation of the rights of any third party.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. Your continued use of the Service after a change constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan, and the courts of Amman shall have jurisdiction over any dispute arising from them.
